By accessing this website (mareedb.com) or downloading and using Maree-DB software, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use this website or the software.

3. Software Licence - Maree-DB Source-Available Commercial Licence

The Maree-DB database software is proprietary, licensed under the Maree-DB Source-Available Commercial Licence v1.0.

Key terms:

  • Proprietary software: All rights in Maree-DB are reserved by David H. Maree. Every use of the software requires a written licence agreement issued by the IP owner or an authorised distributor such as SupportCALL ICT Solutions.
  • Binary distribution: Maree-DB is supplied as a licensed binary per tier. Production and commercial use require the applicable paid tier, except as noted below.
  • Free tier: Community (non-commercial use, 1 node, 1 GB, binary only) is available at no cost. Startups may apply for the Startup Program (the SME tier free for 12 months, renewable on review) as described on the Pricing page.
  • Source-audit rights: Licensed customers and bona fide evaluators may be granted source-code access strictly for security review and audit, under a written non-disclosure and audit agreement. Audit access grants no production, retention, redistribution, or derivative-work rights.
  • Enterprise source escrow: Enterprise customers may add a source-escrow arrangement under a separate written agreement, protecting business continuity.
  • No open-source conversion: The licence contains no change date and no conversion to any open-source licence.

4. Intellectual Property

All intellectual property in Maree-DB - including patent applications in preparation, copyright, trade marks, and trade secrets - is the sole and exclusive property of David H. Maree. SupportCALL ICT Solutions operates as a licensed distributor and holds no ownership of any intellectual property.

The name "Maree-DB" and associated logos are trade marks of David H. Maree. Unauthorised use is prohibited.

5. Disclaimer of Warranties

This website and the Maree-DB software are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

SupportCALL ICT Solutions and David H. Maree do not warrant that the software will be error-free or that it will meet your requirements. You assume all risk associated with use of the software.

6. Limitation of Liability

To the maximum extent permitted by law, SupportCALL ICT Solutions and David H. Maree shall not be liable for any indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of revenue, data, or profits) arising out of or related to use of this website or the Maree-DB software, even if advised of the possibility of such damages.

Our total liability in any matter arising out of or related to these terms shall not exceed the amount you paid for your Maree-DB licence in the 12 months preceding the claim.

7. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Tasmania, Australia, without regard to conflict of law principles. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Tasmania, Australia.

8. Changes to These Terms

We may update these Terms of Use at any time. The "Last updated" date at the top of this page will be updated accordingly. Continued use of the website or software after changes constitutes your acceptance of the updated terms.
